Description
This program identifies legal minefields encountered by both bankruptcy and non-bankruptcy practitioners. At least one hour of ethics credit will be offered and will include the following topics:
1) Preparing for the bankruptcy filing (consumer and commercial).
a. Selecting the current chapter
b. Where to file including domicile and exemptions
c. Pre-bankruptcy planning
d. Due diligence
e. Chapter 11 considerations, including 1st day orders
2) Problems once filed.
a. Fiduciary issues
b. Keeping judges happy
c. Dealing with trustees and creditors & communicating with key constituents
d. Getting paid (issues related to cash collateral, § 523 litigation in individual Chapter 11s, In re Boats, Rule 2016 & Suppl Discl)
3) Reversing court orders
a. Preserving the record
b. Post Order relief
c. What is appealable
d. When appealable
e. Where to appeal

He is a respected lecturer and author on topics regarding bankruptcy, construction, and real estate. His peers have honored him with multiple peer rankings for his professional achievements. Randy has been named to the Super Lawyers’ “Top 50” list of Arizona attorneys multiple times and has been selected as one of The Best Lawyers in America© since 2010. Best Lawyers also has three times selected Randy as its “Lawyer of the Year” (Scottsdale), in Bankruptcy and Creditor Debtor Rights (2019) and Bankruptcy Litigation (2021 and 2024). Randy was the President of the American Board of Certification (2024). Randy was inducted into the Scottsdale History Hall of Fame in 2018 in recognition of his life-long commitment to Scottsdale community and cultural services.

was appointed to the U.S. Bankruptcy Court, District of Arizona effective as of January 18, 2013, and served as Chief Judge from 2014-2017. Judge Collins was the 2023 President of the National Conference of Bankruptcy Judges, is a Fellow in the American College of Bankruptcy, is on the 9th Circuit’s Trial Improvement Committee, is on the JCUS’s Bankruptcy Judges Advisory Group, was on the national Board of the American Bankruptcy Institute and is currently a Business Court Representative in the American Bar Association’s Business Law Section. He was a founder of the Arizona Bankruptcy American Inn of Court chapter, served as the board Chair for the Foundation for Senior Living, was on the St. Teresa Parish Finance Committee and Parish Council, received the St. Thomas More Award for the St. Thomas More Society, was named a Significant Sig by the Sigma Chi fraternity and named to the Sigma Chi’s Beta Phi Chapter Hall of Fame. Dan and his wife Dr. Roseanne Collins raised their 5 children in Phoenix, Arizona.

She focuses her practice on representing individual and commercial clients through Chapter 7, 11 (including Sub V), and 13 bankruptcies. Krystal obtained her J.D. from Phoenix School of Law in 2012; she started working with James F. Kahn in 2002, moving her way up from file clerk/receptionist, to secretary, to paralegal, and eventually to lawyer. Krystal became certified as a Bankruptcy Specialist by the State Bar of Arizona in 2020. She was honored to be a member of the 2020 Class of American Bankruptcy Institute’s 40 Under 40 Program and to be on Super Lawyers’ 2021 Southwest Rising Stars® list, an honor reserved for only 2.5 percent of attorneys in the region. Her practice focuses on debtor/creditor rights, business disputes, and commercial litigation in state and federal court, including a broad range of contested and adversary matters in bankruptcy court. She also represents debtors and creditors in Chapter 11 reorganizations and Chapter 13 and 7 proceedings. In 2022, she was selected by the National Conference of Bankruptcy Judges (“NCBJ”) as a Blackshear Presidential Fellow. She is participating in the NCBJ Next Generation Program in October 2023. She has been recognized as a Rising Star® in the Bankruptcy category of Southwest Super Lawyers® and Ones to Watch® category of Best Lawyers®.
