Erin Dunlap


ERIN F. DUNLAP is affiliated with Coppersmith Brockelman PLC on designated matters; she is admitted to practice in Missouri and Illinois.  Erin advises clients working in the health care industry on regulatory and compliance matters, focusing primarily on data privacy and security issues arising under:
•The Health Insurance Portability and Accountability Act and its implementing regulations (HIPAA amended by the Health Information Technology for Economic and Clinical Health Act (HITECH);
•The Federal Regulations Governing the Confidentiality of Substance Use Disorder Patient Records (42 CFR Part 2); and
•State privacy and breach notification laws
As a former litigator who successfully represented clients in federal and state courts and before arbitrators, federal and state agencies and state licensing boards, Erin is particularly well-equipped to lead clients through privacy and security-related government investigations. She regularly works with the Department of Health and Human Services, Office for Civil Rights (HHS/OCR), state Attorneys General and state agencies in resolving privacy and security-related investigations (without penalty or payment) following data breaches, patient complaints and whistleblower claims.  Erin also has extensive experience developing privacy and security policies/template forms, negotiating business associate agreements, assisting clients through privacy and security audits, analyzing impermissible uses and disclosures, preparing written risk assessments and breach notification letters, working with de-identification experts, responding to subpoenas and other types of requests for health information, drafting notices of privacy practices, reviewing/revising website privacy policies, performing due diligence on privacy and security matters in connection with health care transactions and analyzing marketing campaigns and other types of communications with patients/consumers under state and federal laws, including HIPAA, the Telephone Consumer Protection Act (TCPA), Controlling the Assault of Non-Solicited Pornography and Marketing Act (CAN-SPAM) and Section 5 of the Federal Trade Commission Act (FTC Act).  Erin received her J.D. from Northwestern University School of Law and her B.A. from the University of Notre Dame.  Contact Information: P: 314.255.5988 | edunlap@cblawyers.com
