Early in 2023, Congress passed the Pregnant Worker’s Fairness Act, which went into effect on June 27, 2023. The EEOC released its final regulations for the PWFA on April 19, 2024 and those went into effect on June 18, 2024. The PWFA aims to protect pregnant workers and their pregnancies by codifying pregnancy discrimination as unlawful and requiring that employers provide reasonable accommodation. This session will cover the PWFA’s scope, definitions, and protections, as well as its similarities and differences with the ADA and the PDA. EEOC attorney Jillian Edmonds will provide an overview of the new law, examples of recent cases filed under the PWFA and answer questions about the PWFA.
