Description

This program will examine the U.S. Supreme Court’s recent decision in SEC v. Jarkesy, addressing the constitutional right to a jury trial in administrative enforcement actions.  The presentation will then turn to how courts and tribunals —including Arizona’s—have approached similar arguments, particularly in state administrative proceedings.  Broader implications for administrative adjudication and practitioner strategy will also be explored.

Scott Andersen is principal at Andersen, P.C. (finLawyer.com), a SEC and FINRA defense law firm with a national practice originating in Manhattan. Mr. Andersen started Andersen, P.C. in 2015 and has focused primarily on securities regulatory defense and complicated securities and cryptocurrency/blockchain matters. Prior to private practice, Mr. Andersen was deputy Regional Chief Counsel at the Financial Industry Regulatory Authority (FINRA) in Los Angeles, where he oversaw all FINRA enforcement cases prosecuted by the Los Angeles o?ice and managed the West region’s (Los Angeles, San Francisco, Denver and Seattle) attorneys (March 2012 to February 2015). His earlier positions include: Enforcement Director, FINRA, NYC, July 2007 to March 2012; Enforcement Director, NYSE Regulation, Inc., NYC, December 2004 to July 2007; Trial Counsel/Senior Special Counsel, NYSE Regulation, Inc., NYC, August 2003 to December 2004; Co-Chief, Securities Prosecutions Unit, Bureau of Investor Protection and Securities, O?ice of the New York State Attorney General, NYC, June 1999 to August 2003; and Assistant Attorney General, O?ice of the New York State Attorney General, NYC, August 1995 to June 1999. Mr. Andersen was an Adjunct Professor at Albany Law School, where he taught on securities fraud and financial crime. He is a member of the Executive Council, Securities Regulation Section of the State Bar of Arizona.

Alan Baskin joined Weiss Brown in 2021 after 17 years as a partner and owner of his own firm, having co-founded Baskin Richards PLC in 2013 after nearly ten years with Bade Baskin Richards (the first seven as Bade Baskin). His practice emphasizes securities litigation, arbitration and enforcement proceedings. He was the 2012-2013 Chairman of the Executive Council of the State Bar’s Securities Regulation Section. Alan was formerly an Assistant Attorney General in the Organized Crime and Fraud Section of the Criminal Division of the Arizona Attorney General’s O?ice and was Senior Counsel in the Enforcement Section of the Securities Division of the Arizona Corporation Commission. He received his B.A. in economics from Georgetown University and his J.D. from Arizona State University College of Law. Alan believes he is the only attorney over the past 20+ years to obtain an award of attorneys’ fees against the Arizona Corporation Commission in an appeal of a securities case; he has done so twice. He has chaired or sat on the Securities Regulation Section’s State Bar Convention CLE panel multiple times, and has also been a panelist or chair of a number of state and county bar programs related to enforcement proceedings by securities regulators, securities litigation and arbitration, and white collar crime. Mr. Baskin has long held an AV® Preeminent® Martindale- Hubbell Rating and for the past several years has been named a Southwest Super Lawyer®. He has also been named one of PHOENIX Magazine’s Top Attorneys for Securities Law since 2022.
