Join us for an update on medical malpractice law. During the program, faculty will cover the following topics:

  • Negligent Supervision / Negligent Credentialing Claims & Expert Selection, Retention & Challenges
  •  Mediations in Medical Malpractice Cases:  Special challenges, tips, and considerations
  •  Non-Parties at Fault: The pros and cons of designating non- parties at fault and how plaintiffs deal with this issue

The program will close with a review of new medical malpractice cases.

Amy Hernandez received her law degree in 2003 from Drake University (with Honors). After law school she served as a law clerk at the Arizona Court of Appeals. Ms. Hernandez has served on the Civil Practice & Procedure Committee for the State Bar of Arizona and as the Chair of the State Bar Trial Practice Section. She is a former member of the Morris K. Udall Inn of Court and a former board member for the Arizona Association of Justice. Ms. Hernandez served in the United States Army from 1996 - 2000 as a military intelligence analyst. Ms. Hernandez owns Hernandez Linton Law, PLLC where she focuses her practice on plaintiff’s medical malpractice, legal malpractice, and general personal injury.

In his litigation practice, David represents every type of healthcare provider. He successfully represents and defends these clients in matters involving alleged medical malpractice, violations of the Adult Protective Services Act, wrongful death, and medical battery. He also represents healthcare providers in matters pending before administrative licensing boards. In addition to representing healthcare providers, David represents individual and institutional clients in personal injury and wrongful death cases. Highly regarded in the Arizona long-term care industry, David has successfully served as an expert witness for the industry in the passage of several tort reform bills. These bills have positively impacted all Arizona healthcare providers by reducing the statute of limitations from seven years to two years and eliminating the attorneys' fees provision in cases filed under the Adult Protective Services Act. David also serves as a mediator in all types of civil cases, including medical malpractice cases, and has been inducted in the National Academy of Distinguished Neutrals.

is one of the founding partners of Fadell Cheney & Burt in Phoenix, Arizona. Gary and his partners opened their practice in December, 1996. Gary represents a wide variety of healthcare providers in Arizona, including hospitals, physicians, nurses and other providers in professional malpractice litigation and regulatory proceedings. Gary has tried approximately 90 cases to jury and serves as a Judge Pro Tem with the Maricopa County Superior Court. Gary is a graduate of Michigan State University, Detroit College of Law. He serves on the faculty of the State Bar Trial College.

Mark primarily practices in the areas of plaintiff’s personal injury and wrongful death, products liability, and corporate litigation. He is a certified specialist in the areas of personal injury and wrongful death litigation. Mark is a Fellow of the International Society of Barristers and was named as one of the 500 Leading Plaintiff Consumer Lawyers by Lawdragon. In March 2018, Mark and his trial team obtained a $3.6 million award in the first bellwether trial of the multi-district litigation which was one of the top ten civil verdicts and the largest award of punitive damages in Arizona in 2018. In April of this year, Mark obtained a $3 million dollar plaintiff’s verdict as lead trial counsel in Mixson v. C.R. Bard, Inc. in the Northern District of Florida.
