What are the steps to providing prelitigation risk management, and why is it still important 167 years into the modern construction era? Shouldn’t standardized agreements, standards, forms, advanced visioning software, the rise of AI, and instantaneous communication systems render risk management for new projects unnecessary? To the extent that may be possible, we are not there yet. This presentation will examine the influences that continue to make risk management a fundamental aspect of the modern construction environment for contractors, owners, and counsel.

Todd received his B.A. from the University of South Dakota in 1992 and his J.D. from Tulane University Law School in 2006.
