Description
Nobody Made the House Payment – What Happens Now? This discussion will review the fundamentals of a foreclosure action, following default on a secured loan. Because the deed of trust is by far the predominant instrument in use for securing real estate loans (and especially home loans), this seminar will focus on residential deeds of trust, what happens following a default, and the homeowner's rights, responsibilities, and potential defenses.
Topics Include:
- Demand
- The basics of a trustee’s sale
- Reinstatement or Loan Payoff
- Deficiency liability (and defenses)
- Excess proceeds
- Potential defenses
The discussion will be oriented toward the practitioner who is not an expert in foreclosure law, but who is looking to understand the basics of foreclosure.

He focuses his practice on civil litigation, creditors' rights, commercial bankruptcy, restructurings, related litigation, appeals, and mediation. Robert represents credit unions, institutional clients, student loan creditors, corporations, partnerships, and individuals in all areas of creditor and debtor relations. Prior to law school, Robert worked as a business consultant for RSM US LLP, an international provider of audit, tax, and consulting services. This experience coupled with B.S. degrees in Finance and Business Administration gives Robert a practical perspective and understanding of business operations and finance. Before joining Gust Rosenfeld, Robert worked for two years as a law clerk to the Hon. Robert D. Berger of the U.S. Bankruptcy Court for the District of Kansas. Robert received his bachelor's degree and J.D. from the University of Kansas.
