Description

Supported Decision-Making (SDM) is a nationally recognized alternative to guardianship that enables individuals with disabilities to retain their legal rights while receiving support from trusted persons to make decisions about their lives. In Arizona, courts and attorneys can recognize SDM in determining whether an individual subject to guardianship can have their needs met with a “less restrictive alternative.” With recent legal developments, including the Wood v. Coconino decision on voting rights, and other guardianship cases involving supported decision-making nationwide, the judiciary plays a critical role in ensuring that due process, autonomy, and civil rights are protected through recognizing SDM as an alternative to guardianship.
 
By the end of this session, participants will be able to:

  1. Explain the principles of Supported Decision-Making and its role as a less restrictive alternative to guardianship in Arizona.
  2. Apply SDM concepts when evaluating guardianship petitions, ensuring due process and compliance with the least restrictive alternative standard.
  3. Recognize how attorneys and judges can use SDM to preserve individual rights while still addressing legitimate concerns about decision-making capacity.

Sey In is a staff attorney with Disability Rights Arizona (DRAZ, formerly Arizona Center for Disability Law). He has been with ACDL for 7 years working on various issues involving healthcare and civil rights matters. He has trained various stakeholder groups on supported decision-making.

Melanie Mills is the State Director for The Arc of Arizona. She has been with The Arc for 23 years and has spent her entire career supporting and advocating for the IDD community. She has served on various advisory committees and coalitions including those focused on guardianship & supported decision-making training and supports.
