Description

Join us for a timely discussion on the evolving role of the appellate courts in the shifting landscape of administrative law. Using environmental law and the Clean Air Act as a case study, we will examine how agency rulemakings and the courts interact with a changing administration. The session will explore recent Executive Orders directing the EPA to revisit prior rules, the legal standards agencies must meet to change course, and the principles appellate courts apply when reviewing those shifts. We’ll also consider how the United States Supreme Court is shaping this process — from the procedures emerging in the appellate courts to the limits being placed on agency discretion.
