Advanced Estate Planning Seminar – This seminar will cover the following two topics.

 

Asset Protection Planning in Arizona without a Domestic Asset Protection Trust Statute.

  • This presentation will discuss when a trust is considered self-settled, the traditional rules against self-settled trusts, arguments for and against domestic asset protection trusts, common features of domestic asset protection trusts, and considerations, legal and practical, in forming and funding domestic asset protection trusts. In addition, this presentation will discuss domestic asset protection trust case law and alternatives to domestic asset protection trusts.

Income Tax Basis Planning

  • This presentation will consider the effect of increased estate tax exemptions and adjustments to tax rates on income tax basis planning, including the effect of different asset classes on income tax basis planning. Then, we will discuss income tax basis planning opportunities including the use of a senior generation’s estate tax exemption, planning between spouses, the use of partnerships for tax basis planning, and other opportunities. In addition, this presentation will discuss flexible planning alternatives to consider to maximize the ability to preserve estate tax exemptions while also maintaining the ability to take advantage of a step-up in cost basis at death as well as how to integrate this planning into preexisting trusts.

Robin is this year's Chairperson for the Executive Council of the State Bar of Arizona's Probate and Trust Section and a member of the State Bar of Arizona Estate and Tax Law Advisory Commission.
