New Rules Regarding Health Care Powers of Attorney and Visitation

In September of 2022, the Arizona Legislature enacted a new statute regarding access to Principals who are incapacitated.  The new law limits the Agents ability to restrict persons who have a connection to the Principal and will require Agents to file Court actions.  As practitioners, there are strategies we can help them include in their HCPOAs to give Agents broader powers to control visitation and avoid Court action.

Teresa Lancaster Teresa started her life in Fargo, North Dakota until leaving for college. She graduated from the University of Arizona in 2005 and attended the John Marshall Law School (now the University of Illinois Law School at Chicago) and graduated in 2008.

She started her career at Bogutz & Gordon, P.C. in 2008 and became a Shareholder in 2015. Teresa became a certified specialist in Estates & Trusts in 2015 through the State Bar of Arizona. During her career she has served as president of the Arizona chapter of the National Academy of Elder Law Attorneys, currently serves on the Arizona Fiduciary Board through the Arizona Supreme Court, is a member of the American College of Trusts and Estates, and has been named a Best Lawyer.

In her free time she enjoys her family, including her husband and two daughters. Together they hike, ski, and generally enjoy being together.
