For more than a year, the pandemic has led to the entry of emergency orders by the state, cities and counties as governmental officials have struggled to address the pandemic by establishing restrictions and guidance to address public health and public safety concerns. In turn, the Legislature and courts have responded in a variety of ways in response to concerns raised by governmental officials and other individuals and groups. What does the advent of a pandemic or other emergency mean in terms of the exercise of executive power, agency authority, local control, and the separation of powers? What have we learned and what remains unanswered?

Judge (retired) Gerlach will deliver a presentation on the administrative appeal process and considerations for JRAD advocates. The program also will feature a case law and legislative update.
