During this CLE program, Water Law Professionals will cover several topics related to water law and policy. Description: Arizona’s Water Adjudications – some of the most complex legal proceedings in Arizona’s history – are moving forward at a rapid pace. Interested persons will hear relevant updates on the proceedings, while reviewing several essential elements such as:

- State-Law Based Water Rights
- Federal Reserved Water Rights
- Tribal Water Rights
- Surface Water v. Groundwater

Exploring Active Management Areas, Groundwater, and the Governor’s Water Policy
Description: As Arizona’s supply of surface water continues to encounter reductions and supply shortages, groundwater supply is facing increasing conservation and regulation. Attendees will explore the changing landscape as it relates to groundwater throughout Arizona and come away with an understanding Active Management Areas, the impact to groundwater users in those areas, and existing and future policy directives from the Governor’s Office.

Nicole D Klobas
Nicole D. Klobas is Chief Counsel for the Arizona Department of Water Resources. A graduate of the Sandra Day O’Connor College of Law at Arizona State University, she has represented the Department since 2003 in various matters, including Assured and Adequate Water Supply, groundwater, water banking, and Colorado River issues. Ms. Klobas has represented the Department in workgroups, rulemaking proceedings, and administrative hearings, as well as appellate proceedings. She participated in negotiating and drafting agreements and documents related to the 2007 Interim Guidelines, Minutes No. 319 and 323, the Drought Contingency Plans, and the 500+ Plan.
Kimberly R Parks
serves as Deputy Counsel for the Arizona Department of Water Resources where she represents the Department in all matters relating to the general stream adjudications. Ms.Parks also serves on the Executive Council for the Environmental and Natural Resources Section of the State Bar of Arizona. Prior to joining ADWR, Ms. Parks was an Assistant Attorney General in the Antitrust Division of the Ohio Attorney General's office and a felony prosecutor for the Commonwealth of Kentucky. Ms. Parks is a graduate of The Ohio State University and Capital University Law School.
Kevin Patrick Crestin
Kevin Crestin has been with the Natural Resources Section of the Arizona Attorney General’s Office since 2018. He represents the Arizona State Land Department and other state agencies in Arizona’s General Stream Adjudications and provides advice on water resource issues. Prior to joining the Attorney General’s Office, he was a law clerk for the Arizona Court of Appeals.
Emily Elizabeth Petrick
Emily Petrick is a Deputy Counsel at the Arizona Department of Water Resources and advises the Department's Active Management Areas and Assured and Adequate Water Supply programs. Previously, she was an Assistant Attorney General at the Arizona Attorney General's Office in the Consumer Protection Division and at the Texas Attorney General's Office in the Environmental Protection Division.
Kalyn Dyanne Behnke
Kalyn Behnke is an Assistant Attorney General at the Arizona Attorney General’s Office. Her primary areas of practice include condemnation, NEPA compliance, zoning, and land use permitting issues. She represents the Arizona Department of Transportation in various administrative proceedings and litigation matters. Kalyn earned two B.A.’s, an M.A., and a J.D. from Arizona State University.
Elias James Ancharski
Eli Ancharski is an associate with Osborn Maledon, where he is a member of the firm’s Energy, Water, and Utility Practice Group. Eli’s specialty involves providing counsel to private companies spearheading energy development and environmental initiatives in Arizona. Eli frequently works as the bridge between companies and Arizona’s governing regulatory agencies. Using his expertise in government and regulatory law and state and local administrative law to accompany clients through transactional and regulatory hurdles, Eli’s counsel includes preparing his clients’ proposals for compliance and ultimate success. His clients include water utility companies, electric cooperatives, energy developers, energy procurement companies, telecommunications providers, and energy interest groups. Eli holds a B.S. from University of Pittsburgh and a J.D. from Vermont Law School.
