Clients  (and lawyers, for that matter) often refer to a trust as being “an Arizona” trust, or a trust of another state. But what does that really mean? The interplay of jurisdiction, venue, situs and governing law can make it challenging to determine where a trust resides, and whether the answer might be different for different purposes. This seminar discusses the drafting techniques that can be employed to minimize confusion by clarifying the rules that will apply for interpreting and administering the trust.
